YesTax HMRC Enquiry Resolution: Glowing Feedback Received!
HMRC’s incessant drive for compliance in the R&D tax relief sector has resulted in YesTax’s HMRC enquiry resolution service being busy of late. In March, we were contacted by a small engineering company that had used a well-known rogue adviser. This had prompted an enquiry into the company’s latest claim for R&D tax relief. The enquiry had been ongoing for several months and HMRC had issued their View of the Matter.
On review of the claim, it was clear at the outset that the company had been incorrectly advised (which was accepted by the claimant company). The entirety of the claim was invalid, and the company faced repaying the whole of the R&D tax credit which had been paid out by HMRC several months earlier. In addition, the company was at risk of penalties, as well as discovery assessments for earlier claims made by the company (which had been prepared by the same adviser).
YesTax was engaged to assist and deliver the best possible outcome for the company. John Moxon (link to LinkedIn bio) took on the case and prepared a carefully drafted response to HMRC’s most recent letter.
This week, we were delighted to learn that the enquiry had been closed, with no penalties and no discovery assessments raised. We received the following comments from the client:
I wholeheartedly believe that your involvement and writeup in the submission was the reason HMRC decided to issue us with "mistakenly submitted" rather than carelessness or even worse. This has resulted in no penalty. This is without doubt, realistically the best outcome we could have hoped for.
